Privacy Policy for the Raymond F. Kravis Center for the Performing Arts, Inc.

At The Raymond F. Kravis Center for the Performing Arts, Inc. (“Kravis Center”), we respect your right to privacy and are committed to protecting your personal information. Our Privacy Policy is intended to help you understand what personal information we may collect from you, how we use such information and the choices you have regarding our use of this information. By engaging our services and agreeing to transact with us through our website, you agree to abide by the following Privacy Policy. This privacy policy discloses the privacy practices for Kravis Center (“we”, “our” or “us”) and our website; kravis.org, its subdomains, and related domains, including any of our social media pages (collectively referred to as the “Website”), our services, features, content and applications, including the mobile optimized versions of these sites and our Mobile Device Applications or “Apps” (collectively with the Website, the “Services”). We receive information about you from various sources, including (i) your user account (“User” or “User Account”); (ii) your interaction with our Services; and (iii) from third party sources and services. This privacy notice applies solely to information collected by the Website, except where stated otherwise. It will notify you of the following:
• What information we collect;
• With whom it is shared;
• How it can be corrected;
• How it is secured;
• How policy changes will be communicated; and
• How to address concerns over misuse of personal and company data.

This Privacy Policy governs your use of Website and Services in the United States unless otherwise indicated. This Privacy Policy is also incorporated and made a part of our Terms and Conditions for Use of our Site. Please review the Terms and Conditions. If you do not agree with our Privacy Policy or Terms and Conditions please do not use our Site.

Information Collection, Sharing and Use
This Privacy Policy contains the handling of user information (“User Information”) collected when you are using our Website or Services. This User Privacy Policy also covers our handling of the User Information our partners and clients share with us, and the User Information we share with our partners and clients. “Personal information” is any information that we can use to identify, locate or contact you, including, but is not limited to, name, address, telephone number, e-mail address and credit card information.

a. Anonymity.
You may purchase tickets and remain anonymous if you choose to pay by cash in person at our Box Office, and not avail yourself of the Website and Services.
b. General Information.
You may visit and browse our Websites as often as you like without logging in and no personal information about your visit will be collected. If you visit our Websites simply to browse, we may collect general information about the way in which you use our Websites, including, but not limited to, the time and duration of visit, type of web browser used, the operating system/ platform you are using, your IP address, the websites from which you linked to us, and your CPU speed. We also may note whether and how you use the Websites by recording site traffic patterns and clickstreams. We do not associate this general information that we collect with any personal information and we do not otherwise monitor this information on an individual basis. Instead, we aggregate this usage information and use it only to identify the levels and areas of interest in the Kravis Center and to improve and refine our Websites and Services. We may perform (or have third parties perform) analyses of visitors’ behavior, and may share aggregated, anonymous data with sponsors and advertisers.
c. Personal Information.
The Kravis Center collects personal information when you make a purchase or a contribution, register, request information on our products and services, participate in a promotion or an online survey, or contact the Kravis Center with a question, comment or suggestion. Depending on the nature of your interaction with the Kravis Center, we may ask you for information such as your name, phone number, physical address, email address, credit card information including expiration date and billing address, and product preferences. Once you register with the Kravis Center and sign in to our Services, you are not anonymous to us.

By using our Services and/or registering for an account with us, you are accepting the terms of this Privacy Notice, “accepting” your User Account, and you are consenting to our collection, use, disclosure, retention, and protection of your information as described in this Privacy Policy. You may be asked to provide a user name (“User Name”) and password. You may also be asked to provide certain user information and other personally identifiable information about yourself (collectively “User Information”), such as your first and last name, company name, billing and shipping address, telephone number, and e-mail address. The Website allows you to update certain information when you are logging in. If you provide us with User Information, we will take all reasonable and appropriate steps to protect it from unauthorized disclosure. You are also responsible for maintaining and updating the registration information in your User Account with current and complete information. You should be aware that it is not always possible to completely remove or modify information in our databases. In addition, we may institute a policy in which User Information is deleted after a certain amount of time, and therefore, your User Information may no longer exist in our active databases. Even if you choose to unsubscribe or otherwise modify your User Account settings, the Kravis Center reserves the right to contact you regarding your account and your use of this Website and/or the Services.

Your personal information may be used by us (or third parties engaged by us) to: (1) customize the advertising and the content that you see, (2) fulfill your requests for products and services, (3) contact you, (4) conduct research, (5) respond to subpoenas, court orders or legal process, (6) establish or exercise our legal rights or defend against legal claims, (7) to screen orders for potential risk or fraud, and (8) to administer your account.

If you provide your e-mail address the Kravis Center may contact you periodically with special offers, updated information and new services. Any e-mails sent to you by the Kravis Center offer you the option to be removed from the e-mail mailing list. Also, you can edit personal information in your account with us, specifically your name, address, and phone number through our Websites or by contacting us at the phone number or mailing address listed at the end of this document.

Selected applications on our Website allow visitors to subscribe to our newsletter by providing their names and addresses to the Kravis Center. If you provide the Kravis Center with your mailing address or telephone number, the Kravis Center, in addition to providing you with the Kravis Center newsletter, may also use this information to alert you to updated information and new services. If you wish to be removed from the mailing list, change or correct any data we have about you, you may do so by contacting the Kravis Center directly at privacy@kravis.org.

Information to Third Parties
a. The Kravis Center may occasionally present a special contest or promotion on its Website that is sponsored by another company. To qualify for entry, we may ask you to provide personal information. If we plan to share that information with the sponsor(s), we will provide a statement to that effect.
b. Certain performances at the Kravis Center are presented or promoted by third parties. When you make a purchase to a performance presented or promoted by one of these third party organizations, the Kravis Center may provide them with information regarding your purchase. This information may include, but shall not be limited to, your name, address, telephone number and email address, as well as details of your purchase, which may include, but shall not be limited to, the date you purchased your tickets, any offer you responded to, the locations of your seats, and the dollar amount of your transaction.
c. The Kravis Center may share your information with our subsidiaries, affiliates and companies acquired by or merged with us and our affiliates. The Kravis may also work with third parties to provide some Services on our Website. In connection with those Services, you are deemed to consent to us sharing User Information with third parties who provide services including, but not limited to, credit card processing, customer service, promotions, and order fulfillment. These third parties do not have any right to use User Information or information shared with them beyond what is necessary to assist in providing the Services. We will use commercially reasonable efforts to prevent such third parties from disclosing User Information, except for providing such Services. We cannot guarantee that these third parties will not disclose our User Information and will not be liable for any unauthorized use or disclosure by any third party.
d. The Kravis Center will share information in order to comply with state and federal law. We will share information to respond to a court order or subpoena, or to establish or exercise our legal rights or defend against legal claims. We may also share it if a government agency or investigatory body requests. We may also share information to protect us, or our site, or our users. We might share information with other companies for fraud and credit risk reduction.
The Kravis Center does not sell, rent, swap or otherwise disclose any of your personal information in any manner other than those explicitly defined above. We may not control how our User Information is handled in the event of a bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of law when applied to creditor rights.

Financial information
The Kravis Center will protect any personal financial information that you share with us. If you make a purchase on-line, we will use your credit card number only to process your payment and will not use it for marketing purposes. For reasons of security, credit card information is not stored on our Web Server. We will retain order information for our records, but this information is never shared with third parties.

Links

Our site includes links to other websites whose privacy policies we don’t control. Once you leave our website (you can check where you are by checking the URL in the location bar on your browser), use of any information you provide is governed by the privacy policy of the operator of the site you are visiting. That policy may differ from ours. If you can’t find the privacy policy of any of these sites via a link from the site’s homepage, you should contact the site directly for more information. The Kravis is not responsible for the privacy practices or the content of such websites.

Cookies

Certain applications in the Kravis Center website invoke a standard feature found in browser software, called a “cookie.” We use cookies only to track the progress of e-commerce transactions and to allow site users to move from one page to the next without having to re-enter personal order information. We do not use cookies to track user sessions, and we do not use or share information transferred through cookies with third parties for marketing or other purposes. Usage of a cookie is in no way linked to any User Information on our site. Some of our third-party business partners may use cookies on our site. However, we have no access to or control over these cookies. Most browsers will allow you to configure the use of cookies on your browser. You should refer to your browser instructions, or “Help” screen for more information. However, it is possible that some parts of this Website will not operate correctly if you disable cookies and you may not be able to take advantage of some of this Website’s features. You should consult with your browser’s provider/manufacturer if you have any questions regarding disabling cookies. We may also collect information through web beacons; tags; pixels which are blocks of code that can read and place cookies, recognize certain types of information on your device, such as which websites or apps you use, and your browsing behavior, as well as provide Service analytics. Mobile device identifiers also collect information and these are standard device identifiers, for example the “IDFA” advertising identifier used on Apple’s iOS devices and the “Google Advertising ID” advertising identifier used on Android devices, to analyze your use of mobile applications.

Widgets
We may include a widget from a third party on the Websites that allows interaction or content sharing by users. “Widgets” are mini-programs (such as a Facebook “Share” or “Like” button) that provide specific services or content from a third party. The third party providing the Widget may offer controls for you to manage the Widget’s appearance and functionality. Your interaction with a Widget typically allows the third party to collect some information about you through the third party’s cookies or its registration information. In some cases, the third party may recognize you through its Widgets and cookies even when you do not interact with the Widget. Children Under the Age of 18

We do not solicit personal information from children. All account owners must be at least 18 years of age. In some cases, children may give us information without us knowing about it. If you are a parent or legal guardian and believe that your child under 18 has provided us with personally identifiable information, please email the Kravis Center at privacy@kravis.org. The Kravis Center is committed to complying with all applicable laws and regulations regarding children, including the Children’s Online Privacy Protection Act.

Although the Website is generally not intended for children under 18, we may have subdomains or related domains that are intended to be used by children under the age of 18 years old, or under the age of 13 years old, with the supervision of a parent or guardian. The Children’s Online Privacy Act (“COPPA”) requires that we inform parents and legal guardians about how we collect, use and disclose personal information from children under 13 years of age.  COPPA requires that we obtain the consent of parents and guardians in order for children under 13 years of age to use certain features on the website.  When your child attempts to register and/or provide personal information to us (including the initial participation on any subdomain of our Website) we require parent or legal guardian to:  (a) complete the registration; (b) review our privacy policy and submit a valid credit card number to verify the child’s parent or guardian knows about it, and authorizes our information practices related to children protected by COPPA; and (c) verify through the use of an e-mail confirmation as a second authorization that the parent or guardian consents to the Terms of Use for the website and associated services and this Privacy Policy.

Once parental notice and consent have been verified, the information we collect, will be treated in the same manner as information collected from any other user of the Website.  Without verified parental notice and consent, we will not knowingly collect personal information of children under 13 years of age, which may mean that such children are unable to use the full services of the Website.  If we learn that we have inadvertently collected such information, it will be promptly deleted.  In compliance with COPPA, parents and legal guardians may request us to review, delete or stop the collection of the personally identifiable information of their child.  You may do so by emailing us at privacy@kravis.org, or you may contact us by letter using the address and information provided below.  If you requested no further information about your child be collected or used, we will be required to terminate your child’s ability to use the web pages that require a log in function.]

Privacy Policy Updates
From time to time, we may change, amend, or update this privacy policy. The Kravis Center will notify you of any material changes to this policy as required by law. The Kravis Center will also post an updated copy on the Website. Please check the Website periodically for updates.

Your State Privacy Rights

Some state consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. Colorado provides their state residents with rights to:

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Data portability.
  • Opt-out of personal data processing for targeted advertising and sales.
  • Colorado also provides their state residents with rights to:
    • Correct inaccuracies in their personal information, taking into account the information’s natural processing purpose.
    • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.
      To exercise any of these rights please send an email to privacy@kravis.org. To appeal a decision regarding a consumer rights request please send an email to privacy@kravis.org stating the reasons with reasonable detail for such appeal. Although it generally does not apply to non-profit organizations, Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise their sale opt-out rights if and when they may apply to a not-for-profit like the Kravis Center, may submit a request to this designated address: privacy@kravis.org. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

International Transfers of Data from the European Union
The Kravis Center does business in the United States. Information we collect from you will be processed in the United States. The Kravis Center has not sought or received a finding of “adequacy” from the European Union under Article 45 of the General Data Protection Regulation (“GDPR”). The Kravis Center relies on certain derogations for specific situations as set forth in Article 49 of the GDPR. In particular, we collect and transfer to the United States personal data only with your consent, to perform a contract with you, or to fulfill a compelling legitimate interest of the Kravis Center that does not outweigh your rights and freedoms. We endeavor to apply suitable safeguards to protect the privacy and security of your personal data and to use it only consistent with your relationship with the Kravis Center and the practices described in this privacy policy. We may also enter into data processing agreements and model clauses with our vendors whenever feasible and appropriate.
